Lawsuit Information

Our lawsuit against the City of Banning is continuing.  Currently, we are awaiting the

Administrative Record from the City.  This is the documentation of all information on the

case from the City of Banning and the developers.  Often referred to “discovery” in a

criminal case.  Our attorneys will review the information and note and request anything

that is not included.

A progress review, with Judge Riemer, between our attorneys and all other parties’

attorneys is currently scheduled for August 31, 2022. Although it seems tedious and time

consuming, in all lawsuits such as ours, this is how our legal system works, with no way to

shorten or avoid this part of the process. This may result in many back-and-forth meetings

that will continue until both “sides” are satisfied that it is as complete and accurate as

possible. The file then goes to the Court.  We have no way of knowing exactly how long it

will take Banning to produce the Administrative Record nor how long this process might

take, but we will continue to post updates to the website as they occur.

History

The Pass Action Group is made up of volunteers from the local community and we are

always looking for help with fundraising or being involved in any capacity with the P.A.G.

as a volunteer. If you are interested in helping with fundraising or being involved in any

capacity with the P.A.G. as a volunteer, please send an email to

passactiongroup2022@gmail.com.

Since November 2021, the P.A.G. has been registered with the IRS as a 501 (c) (4)

organization. Donors from the local community have helped fund this endeavor. To date,

we have received donations from many 100’s of community members and businesses. All

donations are going to legal fees and operating costs such as printing of flyers, mailings,

etc. The Board of Directors of the Pass Action Group and supporting committees are all

volunteers. All financial support from the community is needed and greatly appreciated.

We are continuing to raise funds for legal fees and other necessary expenses. Remember

that it takes a community to save a community!
