September 11, 2024 - **** WAREHOUSE DENIED! ****
At the City Council meeting on September 10, 2024, the Banning Council voted 3-2 to fully deny the Banning Point project. Council member Flynn, Happe, and Minjares voted for the motion to deny while Mayor Sanchez and council member Wallace voted against the motion to deny.
At the beginning of the meeting which was noted as a continued discussion from the July 9, 2024, meeting, it was not a public hearing as that was closed on July 9th, the developers asked Sheri Flynn to recuse herself on bias issues. She gave very compelling arguments as to why she should not have to recuse herself. The developers never made this request during the Public Hearing,
This battle has been an amazing team effort from current Board Members as well as previous Board Members. Current Board Members are Randy Robbins, Jim Corrigan, Diane Berley, Jeannie Lloyd, Jim Moran, Bob Hix, John Swem, Jan Flammang, Harry Finigan, Gracy Luna, Bruce Brown, Ron Roy, and Lori Matsushita.
Previous Board Members were also keys to our success. Howard Katz, Mike Collins, Lin Taylor, Sheri Flynn, Marsha Midgett, and Bob Messier. If anyone was inadvertently left off our apologies.
Another big shout out to Dorrie Gartzke who created her own project of recycling collection and redemption that has been an awesome success. She will be stopping the project on September 20th.
I would also like to thank our attorney, Kevin Bundy, for his counseling and professionalism in overseeing our case both in the background and in public. We are awaiting our August and September invoices for attorney services. Due to the opposition’s legal wrangling, we will end up with more monies necessary to cover these bills. We have been granted permission from the HOA to sell nuts are the main clubhouse as a fundraiser. We will also be doing a fundraiser dinner with music on October 10th at 5:30 pm. Keep an eye on Facebook pages for ticket information.
Finally, we want to thank every single supporter for donations of money as well as physical and moral support.
We have proven that “It Takes a Community to Save the Community” works and we could not be any prouder to be associated with this amazing community.
September 3, 2024 - ** IMPORTANT REQUEST **
The City Council is expected to submit a resolution denying the Banning Point project. Unfortunately, an appeal by the developers may follow.
We currently have a pending appeal of portions of original court hearing. After the Council ruling it will be determined if we withdraw this appeal.
The legal research and wrangling still require fees, even if we get the project denied.
Donations are still needed and being accepted. They can be sent or dropped off at 4832 Crenshaw Circle, Banning. There is a box on front porch.

August 23, 2024 - ** IMPORTANT MESSAGE **
The next vote on the Banning Point project is NOT on the agenda for 08/27/24 City Council meeting. Currently, we anticipate it to be on the City Council agenda for 09/10/24.
As a reminder, the next vote is expected to be by the City Council voting on a resolution to deny the Banning Point project. The City Council asked for this resolution by a vote of 3-2.
The “legal wrangling” that the developers are currently engaging in has caused the Pass Action Group legal team to do more research and incur additional expenses.
We received pledges after the Town Hall for use during the appeal process on our first. We are humbly making a request for funds now to get us thru the delay and legal wrangling being used by the “other side.” We are nearing the finish line!!!

Recap of recent events - In March 2024 Superior Court Judge Harold Hopp granted a writ of mandate to vacate previous approval of the Banning Point project based on a bias shown by council member Hamlin.
Last night, July 9, 2024, item number 6.2 on the agenda rescinded the previous approval as a formality, vote was 5-0.
This brought us to item 7.1 to approve the project. After presentations from developers and the Pass Action Group. City council members asked questions of both parties. The resolution that was prepared was to approve the project. After much discussion the council did not "vote in" (approve) this resolution. There was then a discussion on how to not approve the project formally. After discussion with the city attorney, the council motioned and voted 3-2 to direct staff to create a resolution for next meeting to deny the application for the project.
This will probably be at the August 27th meeting. Will keep all posted.
