September 11, 2024 - **** WAREHOUSE DENIED! ****
At the City Council meeting on September 10, 2024, the Banning Council voted 3-2 to fully deny the Banning Point project. Council member Flynn, Happe, and Minjares voted for the motion to deny while Mayor Sanchez and council member Wallace voted against the motion to deny.
At the beginning of the meeting which was noted as a continued discussion from the July 9, 2024, meeting, it was not a public hearing as that was closed on July 9th, the developers asked Sheri Flynn to recuse herself on bias issues. She gave very compelling arguments as to why she should not have to recuse herself. The developers never made this request during the Public Hearing,
This battle has been an amazing team effort from current Board Members as well as previous Board Members. Current Board Members are Randy Robbins, Jim Corrigan, Diane Berley, Jeannie Lloyd, Jim Moran, Bob Hix, John Swem, Jan Flammang, Harry Finigan, Gracy Luna, Bruce Brown, Ron Roy, and Lori Matsushita.
Previous Board Members were also keys to our success. Howard Katz, Mike Collins, Lin Taylor, Sheri Flynn, Marsha Midgett, and Bob Messier. If anyone was inadvertently left off our apologies.
Another big shout out to Dorrie Gartzke who created her own project of recycling collection and redemption that has been an awesome success. She will be stopping the project on September 20th.
I would also like to thank our attorney, Kevin Bundy, for his counseling and professionalism in overseeing our case both in the background and in public. We are awaiting our August and September invoices for attorney services. Due to the opposition’s legal wrangling, we will end up with more monies necessary to cover these bills. We have been granted permission from the HOA to sell nuts are the main clubhouse as a fundraiser. We will also be doing a fundraiser dinner with music on October 10th at 5:30 pm. Keep an eye on Facebook pages for ticket information.
Finally, we want to thank every single supporter for donations of money as well as physical and moral support.
We have proven that “It Takes a Community to Save the Community” works and we could not be any prouder to be associated with this amazing community.
September 3, 2024 - ** IMPORTANT REQUEST **
The City Council is expected to submit a resolution denying the Banning Point project. Unfortunately, an appeal by the developers may follow.
We currently have a pending appeal of portions of original court hearing. After the Council ruling it will be determined if we withdraw this appeal.
The legal research and wrangling still require fees, even if we get the project denied.
Donations are still needed and being accepted. They can be sent or dropped off at 4832 Crenshaw Circle, Banning. There is a box on front porch.

August 23, 2024 - ** IMPORTANT MESSAGE **
The next vote on the Banning Point project is NOT on the agenda for 08/27/24 City Council meeting. Currently, we anticipate it to be on the City Council agenda for 09/10/24.
As a reminder, the next vote is expected to be by the City Council voting on a resolution to deny the Banning Point project. The City Council asked for this resolution by a vote of 3-2.
The “legal wrangling” that the developers are currently engaging in has caused the Pass Action Group legal team to do more research and incur additional expenses.
We received pledges after the Town Hall for use during the appeal process on our first. We are humbly making a request for funds now to get us thru the delay and legal wrangling being used by the “other side.” We are nearing the finish line!!!

A Town Hall meeting will be held on Sunday April 7th to answer as many questions as possible and next steps. All questions must be in writing and sent in advance, if possible, to passactiongroup2022@gmail.com.
March 18, 2024 - Judge Harold W. Hopp released his ruling on our case. On the CEQA (California Environmental Quality Act) portion Judge Hopp ruled against the Pass Action Group. This was primarily due to missing a deadline long before the Pass Action Group was formed or we knew about the project. Judge Hopp also ruled that the City of Banning had not violated it's own general plan or specific plan. The Pass Action Group will determine whether or not to appeal.
Judge Hopp did rule in favor of council member Mary Hamlin showing bias. This will require the attorneys to work together and write a "writ of mandate" essentially a court order that will state that the city must reconsider the project. This is assuming the developers will be re-submitting. The opposition has the right to appeal.

March 13,2024 - Hearing was held under Judge Harold W. Hopp of the Riverside Superior Court. Attorneys for the Pass Action Group and attorneys for the City of Banning, Creation Equity, et all presented their respective arguments.
January 31, 2024, 1:30 PM - Hearing in Riverside Superior Court
As you may know, our court hearing that was scheduled for November 17, 2023, was "continued" by the Court. In other words, delayed. No specific reason was given at the time. None of the parties in the case asked for this continuance.
The new hearing date and time are January 31, 2024 at 1:30 PM in Riverside Superior Court. As previously happened, there is always a chance for another continuance.
Pass Action Group Mission Statement
The fundamental mission and purpose of the Pass Action Group (PAG) is to prevent the development of the Banning Point Warehouse.
This mission will use all means necessary to preserve the quality of life and property values of those living in the general vicinity of the Banning Point project, especially the protected class of citizens currently living immediately adjacent to the planned project.
This will be accomplished by the development and implementation of a multifaceted strategic plan constructed to ensure all reasonable and available public, political, and legal means necessary are undertaken.
The funding for this effort will be derived from citizens concerned about the proliferation of excessive warehouse projects embedded in or adjacent to residential communities located in the general vicinity of the Banning Point project.
